These terms (the “Terms”) govern your use of the Hodi.tv platform, mobile applications, APIs and related services (together, the “Service”), provided by HODI TV LIMITED, a company incorporated in England & Wales on 10 June 2021 (company number 13449844), with registered office at International House, Churchill Way, Cardiff, Wales, CF10 2HE (“Hodi”, “we”, “us”, “our”).
By creating an account, taking the Surf Score, joining the Club, booking coaching, generating an AI Lab analysis, messaging another member, browsing surf trip operators, or making any purchase through Hodi, you agree to these Terms. If you do not agree, do not use the Service.
We operate internationally and serve members in the UK and approximately 38 other countries. Section 17 (Governing law & international users) explains how UK law applies and where mandatory local consumer law in your home country still protects you regardless of these Terms.
Hodi connects surfers with credible coaches, training content, group programmes and curated trip operators. The Service currently includes:
Coaching surfaces— Coach directory, offline video review credits (per coach, sold in 10 / 25 / 50 packs), 1:1 Zoom sessions, and the coach annotation studio that produces frame-by-frame markup + voice-over reviews.
Content surfaces— Masterclass video collections (free / one-off purchase / Pro subscription / Pro+ subscription / bundled into Group Accelerators), short clips and personalised montages.
AI Lab— Computer-vision wave analysis built with the Swansea University AI research team. Outputs are illustrative training feedback; see Section 11.
Programmes & events— Group Accelerators (10-week cohort programmes), wavepool camps, private Club sessions, surf-trip operator listings (with last-minute deals), and the Surf Score funnel.
Social surfaces— Crew connections, user-created groups, direct messaging and clip sharing.
We add, remove and modify features in the ordinary course of development. We'll give reasonable notice for material removals affecting paid features.
You must be at least 16 years old (or the higher age of digital consent in your country, where applicable) to create an account. If you are using the Service from a country that sets a higher age threshold for any specific service (e.g. social messaging in some jurisdictions), you confirm you meet the local threshold.
You are responsible for keeping your login credentials secure and for activity on your account. Authentication is provided by our partner Clerk; we do not store your password directly. Notify us promptly if you suspect unauthorised access.
Coaches and trip operators listed on Hodi may be subject to additional terms agreed separately. Those terms supplement (and, where conflicting, prevail over) these Terms only as between Hodi and that party.
Subscriptions (Pro, Pro+). Subscriptions renew automatically at the price and frequency shown at checkout, until you cancel. Cancellation takes effect at the end of the current paid period; access continues until then. You can cancel any time from your account.
One-off purchases. Includes event tickets, wavepool camp bookings, accelerator enrolment, single masterclass purchases and video-review credit packs. Access / entitlement is granted as described at point of sale.
Video-review credits.Sold in 10, 25 or 50 packs and scoped to a specific coach. One credit pushes one of your clips into that coach's queue. Credits do not expire automatically but are non-refundable once a clip has been submitted (the coach has begun work).
Group Accelerators. 10-week cohort programmes. Where the programme bundles content (masterclass collections, included credits) those entitlements last for the duration of your enrolment unless otherwise stated.
Club membership.Annual; includes Surf England registration plus session insurance under our partner's scheme. Membership does not guarantee any specific number of sessions; private sessions run when demand and venue availability allow.
UK / EU consumers — 14-day cooling-off. For distance contracts to which the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or your home-country equivalent) apply, you have a 14-day right to cancel without giving a reason. For digital content delivered immediately and for services you ask us to begin within 14 days, you expressly consent at checkout that we may begin performance during the cooling-off period and acknowledge you lose the right of withdrawal once performance starts.
Events, camps & private sessions. The per-event policy shown at point of booking applies. Default is: full refund more than 4 weeks before, 50% refund 2–4 weeks before, no refund within 6 days of the session. Slot transfers to other Club members are allowed up to the day of the session.
Group Accelerators. Refundable in full up to 7 days before the cohort starts. After the cohort begins, no pro-rata refund is available unless we cancel the programme.
Subscriptions.No partial refunds on mid-period cancellations. We'll refund the most recent charge if you cancel within 48 hours of the renewal and have not used any premium feature in that period.
Nothing in this section affects mandatory statutory rights under your local consumer protection law.
Coaches are independent professionals listed on the Hodi directory. We take reasonable care to verify credentials but we do not employ coaches and do not control the technical content of their feedback. Coaching is educational; surfing carries inherent physical risk and you remain responsible for your own decisions and limits in and out of the water.
Where you push a clip into a coach's queue, the coach ordinarily aims to return a review within 5–7 working days but timing is not guaranteed. If a coach has not delivered within 21 days, contact us and we'll arrange a replacement coach or refund the credit.
The AI Lab provides computer-vision analysis of surf clips (stage segmentation, posture estimates, comparative metrics). The model is informational and educational only. It is not a substitute for human coaching, medical advice or professional safety judgment.
Outputs may contain inaccuracies; we do not warrant they are error-free. Do not rely on AI outputs for decisions about equipment, location, fitness or risk in real-world surfing.
Clips you submit to the AI Lab may be processed by a third-party model partner under appropriate contractual controls. By using the AI Lab you consent to that processing. We do not use your private clips to train new models without specific opt-in consent.
Surf trip operators listed in the directory are independent third parties. Bookings (where supported) are between you and the operator under their own terms. Hodi is not a party to those bookings, does not collect the trip fee, and is not liable for the operator's performance, cancellations or refunds.
Last-minute deals shown on the surf-trips page are events we run (or co-run with named partners). The same event cancellation policy in Section 4 applies.
You retain ownership of any video, image, audio, text or other content you upload (“User Content”). You grant Hodi a worldwide, non-exclusive, royalty-free licence to host, transcode, store, display, and provide it to coaches and crew members you choose, for the duration of your account, solely to operate the Service.
You may permit a coach to publish their reviewed version of your clip via the public share link (`/r/[clipId]`) which you can disable at any time by deleting the clip.
Messaging. Direct messages and group chats are private to participants. We do not actively monitor messages but may review reported content for safety, anti-abuse or legal compliance reasons.
You must own or have permission to upload everything you post. You must not upload anything illegal, defamatory, harassing, sexually explicit, hateful, infringing of third-party rights, or that you obtained without consent.
You agree not to: (a) scrape, abuse, reverse-engineer, decompile, or interfere with the Service; (b) probe, penetration-test, or attempt to bypass our security or rate limits without prior written consent; (c) use the Service to train competing AI models; (d) impersonate or misrepresent your identity or relationship to a coach, brand or person; (e) harass, threaten or abuse other members; (f) post content listed in Section 8 as prohibited; (g) circumvent, disable, remove, or interfere with any digital-rights- management (DRM), encryption, watermarking, signed-URL or other technical protection measure we apply to videos or other content; (h) download, capture, screen-record, transcode, mirror or redistribute any video content other than via the in-product features we provide for that purpose; or (i) develop, distribute or use any tool or service intended to enable any of the above.
We may suspend or terminate access for breaches and may cooperate with law-enforcement requests where legally required.
Prices are shown in GBP unless otherwise stated and include UK VAT where applicable. International members may see converted-currency display prices; the actual charge is taken in GBP and your bank applies its own conversion + any cross-border fees.
Where local indirect tax (VAT, GST, sales tax) applies in your country, we charge or remit it as required by law. Tax invoices are available from your account.
Stripe processes payments on our behalf; Stripe's terms also apply to the payment leg. We capture limited transaction metadata for fraud prevention and accounting, including approximate IP address and country of sale.
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) other than those that cannot be excluded under your local consumer law.
We make reasonable efforts to provide an accurate, useful, and reliable Service but we do not warrant uninterrupted availability, freedom from defects, or that any outputs of coaching, AI Lab analysis or recommendations will achieve specific results.
Subject to the next paragraph and to any liability that cannot be limited under your local mandatory consumer law, our total aggregate liability to you for all claims arising out of or related to the Service in any 12-month period is limited to the greater of (a) the amounts you have paid us for the Service in the 12 months immediately preceding the event giving rise to the claim, and (b) £100.
We do not exclude or limit liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be limited under English law (or your local mandatory consumer law).
We are not liable for indirect, special, incidental, consequential or exemplary loss; loss of profits, revenue, data, goodwill or anticipated savings; or any loss arising from your reliance on coaching feedback or AI Lab outputs in real-world surfing decisions.
You agree to indemnify and hold Hodi (and our directors, employees and contractors) harmless from any third-party claim arising out of: (a) your User Content; (b) your breach of these Terms; (c) your misuse of the Service; or (d) your violation of any law or third-party right. This does not apply where mandatory local consumer law prohibits indemnity.
Our handling of personal data is governed by the Privacy Policy. We comply with the UK GDPR and, where applicable, the EU GDPR and other regional data-protection laws. Where personal data is transferred outside the UK / EEA we rely on standard contractual clauses or other adequate transfer mechanisms.
Data controller.HODI TV LIMITED, International House, Churchill Way, Cardiff, Wales, CF10 2HE. We are registered with the UK Information Commissioner's Office (ICO), reference ZB364397 (registered 05 August 2022, Tier 1). For data-protection requests email contact@hodi.tv.
All Hodi-owned content, code, trademarks, branding and site-design elements are owned by Hodi or our licensors and are protected by copyright, trademark and other laws. You get a personal, non-exclusive, non-transferable licence to access and use the Service while these Terms are in effect. Nothing in these Terms transfers any IP from us to you.
Digital rights management.We may apply technical protection measures to videos and other copyrighted content — including digital-rights- management (DRM) systems supported by our streaming partner, signed playback URLs, watermarking and at-rest / in-transit encryption. Where DRM is enabled on a piece of content, decryption keys are issued only to authorised, authenticated devices for the duration of your entitlement to that content.
You agree not to circumvent or attempt to circumvent those measures. Doing so is prohibited under Section 9 and may also breach applicable copyright and anti-circumvention laws, including the UK Copyright, Designs and Patents Act 1988 (sections 296ZA–296ZF) and equivalent legislation in your country (e.g. Article 6 of the EU InfoSoc Directive 2001/29/EC, the US Digital Millennium Copyright Act, and similar statutes elsewhere).
Coaches and trip operators retain ownership of their own uploaded teaching content and grant Hodi a licence to host and distribute it under their separate agreement with us; the protection measures and prohibitions above apply equally to that content.
You can close your account at any time. We may suspend or terminate your access (with or without notice) where you materially breach these Terms, where required by law, or where continued provision is no longer commercially viable.
On termination: outstanding refunds (if any) will be issued per Section 4. Personal data will be retained / deleted per the Privacy Policy. User-uploaded clips you have made public via share links remain accessible until you delete them.
These Terms and any dispute or claim arising out of them (including non-contractual disputes) are governed by the laws of England & Wales.
The English courts have exclusive jurisdiction, except: if you are a consumer resident in another country and your local law gives you a non-waivable right to bring proceedings in your home country's courts, that right is preserved. Likewise, mandatory consumer-protection laws in your country of residence (including statutory cancellation / cooling-off rights, protection from unfair terms, and any protections that cannot be derogated from by agreement) apply alongside these Terms; nothing in these Terms is intended to override those mandatory rights.
If any provision of these Terms is held to be unenforceable in a particular jurisdiction, that provision will be modified to the minimum extent necessary or severed; the remainder of the Terms will remain in force.
We are not liable for failure or delay in performance caused by events outside our reasonable control (e.g. acts of God, war, civil unrest, government action, pandemic, internet or payment-network outages, supplier failure). Where such an event affects a paid event or session, we'll work in good faith to reschedule or refund.
We may update these Terms from time to time. Where changes are material we'll notify you by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date is acceptance of the updated Terms; if you don't accept, close your account before then and request any unused-period refund per Section 4.
Assignment. You may not assign these Terms without our consent. We may assign to a successor entity or in connection with a corporate reorganisation.
No waiver. Failure to enforce a right is not a waiver of it.
No agency. Nothing creates a partnership, employment or agency between you and us.
Entire agreement. These Terms (together with the Privacy Policy and any product-specific terms shown at checkout) constitute the entire agreement between you and us.
